Abstract

It is trite law that under our customary law, arbitration, which is the voluntary submission of a dispute between not less than two parties for determination, after hearing both parties in a judicial manner by a person or persons other than a court of competent jurisdiction, exists and forms part of our jurisprudence. In customary law arbitration, the arbitrators are usually either the chiefs or elders of a community.
